Welcome to KiliFlying Air ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website kiliflying-air.com (the "Site") and our services, including Medical Evacuation, KiliQuick (Kilimanjaro Helicopter Descent), Scenic Flights, and Chartered Flights (collectively, the "Services"). By accessing the Site or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

1. Eligibility and Account Registration

To use our Services, you must be at least 18 years old or have the consent of a parent or guardian. You may need to create an account to book Services. You agree to provide accurate, complete, and current information during registration and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. Specific conditions apply to each Service:

  • Medical Evacuation: Requires submission of accurate medical information. You must disclose any health conditions that may affect safety. Services are subject to availability and medical approval.
  • KiliQuick (Kilimanjaro Helicopter Descent): Subject to strict safety and eligibility requirements, including health and weight restrictions. Passengers must comply with safety briefings.
  • Scenic Flights: Subject to weather conditions and operational constraints. Passengers must follow crew instructions.
  • Chartered Flights: Custom bookings require advance agreement on routes, schedules, and fees. Additional terms may apply.

You agree not to engage in any conduct that disrupts the Services, including attempting to access restricted areas, overloading systems, or violating aviation regulations.

3. Payments

Payments for Services must be made through our designated payment processors (e.g., Stripe, PayPal). All fees are quoted in USD or TZS, as specified, and are non-refundable unless stated otherwise in our Refund Policy (see Section 5). You are responsible for providing accurate payment information and ensuring sufficient funds. We reserve the right to cancel bookings for non-payment.

4. Cancellations and Changes

Changes or cancellations to bookings are subject to availability and our policies:

  • Cancellations made more than 7 days before the scheduled Service may be eligible for a full or partial refund, less any processing fees.
  • Cancellations within 7 days may incur a fee or be non-refundable, depending on the Service.
  • No-shows or failure to comply with safety requirements will result in forfeiture of payment.
  • We may cancel or reschedule Services due to weather, safety concerns, or operational issues. In such cases, we will offer a rescheduling option or a refund, at our discretion.

5. Refund Policy

Refunds are processed as follows:

  • Eligible Refunds: For cancellations meeting the criteria in Section 4, refunds will be processed within 14 business days to the original payment method.
  • Non-Refundable Cases: Services canceled within 48 hours, no-shows, or instances where safety requirements are not met are not eligible for refunds.
  • Force Majeure: If Services are canceled due to unforeseen events (e.g., natural disasters, government restrictions), we may offer rescheduling or a credit, at our discretion.

6. Safety and Liability

Your safety is our priority, but aviation involves inherent risks. You agree to:

  • Follow all safety instructions provided by our crew.
  • Disclose any medical conditions or special needs prior to booking, especially for Medical Evacuation or KiliQuick Services.
  • Assume responsibility for personal belongings during flights.

KiliFlying Air is not liable for injuries, losses, or damages arising from your failure to comply with safety protocols, unforeseen events, or acts beyond our control. Our liability is limited to the cost of the Service provided, as permitted by law.

7. Intellectual Property

All content on the Site, including text, images, logos, and designs, is owned by KiliFlying Air or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or modify any content without our prior written consent.

8. Hyperlinking to Our Content

You may link to our Site provided the link is lawful, does not misrepresent our Services, and complies with the following:

  • Links must not imply endorsement by KiliFlying Air unless approved in writing.
  • Links must not be used in a way that harms our reputation or suggests unauthorized association.
  • Linking websites must not contain illegal, offensive, or misleading content.

We reserve the right to request removal of any link to our Site.

9. Termination

We may suspend or terminate your access to the Site or Services if you violate these Terms, engage in unlawful activity, or pose a safety risk. You may terminate your account by contacting us at info@kiliflying-air.com.

10. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania. Any disputes arising from these Terms or the Services will be resolved in the courts of Kilimanjaro, Tanzania, unless otherwise required by applicable law.

11. Changes to These Terms

We may update these Terms periodically. The revised version will be posted on the Site with an updated Effective Date. Significant changes will be communicated via email or a Site notice. Continued use of the Site or Services after updates constitutes acceptance.
